This morning in the High Court in Dublin, after Miriam Freeman had spoken for 4 days on her motion against Bank of Scotland (Ireland), she has finally been vindicated in her long running case. She has been ably supported by two of the founder members of DDI Ben Gilroy and John Squires, and by Awaken Longford and others (unnamed) who have all collaborated with the Freeman family to defeat all motions of Bank of Scotland (Ireland) in case of P FREEMAN & ANOR V BANK OF SCOTLAND (IRELAND) LTD & ORS.
Ben and John have been helping fight this case in their role with People For Economic Justice since it started 2 years ago, and in Court 16 this morning Mr Justice Gilligan dismissed the motions put by Bank of Scotland, and finally sent the case forward for full trial on the issue of securitisation. The team has been seeking a full trial without success for some time and have been stymied by counter motions by Bank of Scotland. So critical is this case that the Chief Executive Officer of Bank of Scotland had been required to fly from Scotland to be present in Court.
Now for the first time in Ireland the issue of securitisation of mortgages is going to be heard in court. The ramifications of this will affect almost every mortgage in the state, as the vast majority of mortgages have been combined into financial instruments and sold off as securities to other investors. It was this kind of securitisation that inflated the banking system to a state of bankruptcy and caused the financial bubble that sees us now forced into living under austerity.
In a separate case this week another motion supported by People for Economic Justice against an Irish based bank resulted in the bank settling out of court for a seven figure sum. For legal reasons because of the settlement the case cannot be quoted.
Ben spoke after the case saying that he hoped that those detractors who have been spreading misinformation about how he, and other lay litigants who take on the banks, operate in court, either in the media, printed press and in cyberspace, will be honourable and correct the imbalance they have caused to so many people.
There is now around 12 weeks for full discovery and responses before the case moves on and it may affect any current repossession cases. What we must look at now is what will be the financial fallout. We know the banks are bankrupt and we know the finance ministers have legalised bail-ins, we also know the heads of Ireland’s banks have just met at the Central Bank, a bank who’s legal position was described in court today as a grey area. So now is a time that people must be aware and wary of what the government’s next move may be to protect their system
BRITAIN is unsuitable for human life, the UN has declared.

As forecasters predict ice, snow, darkness and blade-like freezing winds that can actually slice your face off, the UN declared the country uninhabitable and began evacuation procedures.
A UN spokesman said: “We just want to get as many people out alive as possible, then we’ll figure out distributing them across pleasanter places like Spain.
“We’ll be sending helicopters in about a week, keep watching during the X Factor ad breaks for details of where to rendezvous. Maximum two pieces of hand luggage each.
“In the meantime, just stay inside. Do not attempt to leave the house or even look out of the window, it’s far too psychologically damaging.”
British father-of-two Stephen Malley said: “I leave for work in freezing darkness and then I leave the office in freezing darkness.
“I’m sure this country is like a giant haunted house, actively trying to kill its inhabitants.”
In what is emerging as the battle of the billionaires, Trump said he has banned every brand of whisky sold by William Grant & Sons from his resorts and hotels after Michael Forbes, his obstinate neighbour in Aberdeenshire, was voted Top Scot in a ceremony sponsored by the distiller’s leading brand, Glenfiddich.
The closest resident to Trump’s golf course, Forbes won the award last week after a public vote, beating the Olympic tennis gold medallist and US Open winner Andy Murray. Trump said that decision was “an insult to both Andy Murray and Scotland itself”.
Trump claimed that William Grant & Sons, which broke through the £1bn sales barrier this year and owns several of the world’s most popular whiskies, including Grant’s, was jealous of his own inhouse single malt whisky brand.
The distillery sold more than one million cases of Glenfiddich, but Trump continued: “Glenfiddich should be ashamed of themselves for granting this award to Forbes, just for the sake of publicity.
“Glenfiddich is upset that we created our own single malt whisky using another distillery, which offers far greater products. People at our clubs do not ask for Glenfiddich, and I make a pledge that no Trump property will ever do business with Glenfiddich or William Grant & Sons.
“I hereby call for a boycott on drinking Glenfiddich products because there is no way a result such as this could have been made by the Scottish people.”
After suggesting that the voting for Forbes had been fixed by “a small group of detractors” casting multiple votes, he continued: “Glenfiddich’s choice of Michael Forbes, as Top Scot, will go down as one of the great jokes ever played on the Scottish people and is a terrible embarrassment to Scotland.”
William Grant & Sons gave short shrift to Trump’s criticisms, which he first aired on Twitter on Tuesday, insisting it had nothing to do with the voting for the award, which Glenfiddich has sponsored for 15 years.
It had never interfered with the outcome, it said, and insisted Forbes’s victory should be respected.
“We understand that there may have been some confusion and misunderstanding concerning the structure and running of the Glenfiddich Spirit of Scotland Awards,” the firm said in a statement.
“Top Scot is a totally open category in which the people of Scotland can vote for whomsoever they choose and Glenfiddich has no influence on this decision. [The] Top Scot may be one of that year’s category nominees or may come from any walk of life. The person receiving the greatest number of votes, cast by the people of Scotland, wins the award.”
It added: “In the history of these awards, we are not aware of the Top Scot award causing any offence or upset to anyone and it is not our intention to do so now. These awards were set up to give the people of Scotland a vote and we must respect their decision.”

British premier, David Cameron, who knows very well what the EU is and how it will finally reveal itself to be a totalitarian Soviet Fascist state, was all too eager to proffer his congratulations to the EU for its recent Nobel Peace Prize.

When they embrace the EU, as Southern Ireland did, then we as England will be given no choice but to join the EU as well. I know the plan, as do many other cabinet members. Though it barely received any media attention at the time, a renowned British biochemist who back in 1998 exposed the shocking truth about how genetically-modified organisms (GMOs) cause organ damage, reproductive failure, digestive dysfunction, impaired immunity, and cancer, among many other conditions, was immediately fired from his job, and the team of researchers who assisted him dismissed from their post within 24 hours from the time when the findings went public.
Arpad Pusztai, who is considered to be one of the world’s most respected and well-learned biochemists, had for three years led a team of researchers from Scotland’s prestigious Rowett Research Institute (RRI) in studying the health effects of a novel GM potato with built-in Bt toxin. Much to the surprise of many, the team discovered that, contrary to industry rhetoric, Bt potato was responsible for causing severe health damage in test rats, a fact that was quickly relayed to the media out of concern for public hearing.
But rather than be praised for their honest assessment into this genetically-tampered potato, Pusztai and his colleagues were chastised by industry-backed government authorities, including British Prime Minister Tony Blair, whose office was discovered to have secretly contacted RRI just hours after Pusztai and his team announced the results of their study on television. For speaking the truth, Pusztai was immediately fired from his position, and his team dismissed from their positions at the school.
Research out of Egypt finds similar results – GMOs cause severe, long-term health damage
As reported recently in Egypt Independent, similar research by Hussein Kaoud from Cairo University‘s Faculty of Veterinary Hygiene also made some fascinating, though politically incorrect, discoveries about the effects of GMOs on the body. After feeding nine groups of rats varying combinations of GM soy, corn, wheat, and canola, Kaoud and his team observed that these genetic poisons clearly obstructed the normal function of the animals, affirming Pusztai’s research.
I recorded the alteration of different organs, shrinkage of kidneys, change in the liver and spleen, appearance of malignant parts in the tissues, (and) kidney failure and hemorrhages in the intestine,” said Kaoud about the effects of GMOs as observed in the test rats. “The brain functions were touched as well, and the rats’ learning and memory abilities were seriously altered.”
In Kaoud’s case, his groundbreaking findings will soon be published in the respected journals Neurotoxicology and Ecotoxicology. But it remains to be seen whether or not the scientific community at large, which is heavily influenced by biotechnology interests, and the political structures that control it will accept the results as valid, or pull a similar character assassination on Kaoud and his team as punishment for defying the status quo.
What all this clearly illustrates, of course, is that modern science can hardly be considered the independent, truth-seeking, “gold standard” of interpreting and understanding reality that many people mistakenly think it is. The truth about GMOs, as uncovered by mounds of independent research, is that they are inadequately safety tested, at best, and deadly at worst. But this fact remains shrouded in deception, thanks to the corporatized, pro-GMO culture of mainstream science.

In 1995 the Árpád Pusztai began research on genetically modified potatoes containing the GNA lectin gene from the snowdrop plant. His group fed rats on raw and cooked genetically modified potatoes, using Desiree Red potatoes as controls. In 1998 Árpád Pusztai said in an interview on a World in Action programme that his group had observed damage to the intestines and immune systems of rats fed the genetically modified potatoes. He also said “If I had the choice I would certainly not eat it”, and that “I find it’s very unfair to use our fellow citizens as guinea pigs”.
This resulted in a media frenzy, and Rowett Institute’s director Philip James, after initially supporting Pusztai, suspended him and banned both Pusztai and Susan Bardocz from speaking publicly. He also used misconduct procedures to seize the raw data. The Rowett Institute published an audit criticizing Pusztai’s results and sent the raw data to six anonymous reviewers who also criticized Pusztai’s work. Pusztai responded that the raw data was “never intended for publication under intense scrutiny”. Pusztai sent the audit report and his rebuttal to scientists who requested it, and in February 1999, twenty-one European and American scientists released a memo supporting Pusztai.
Pusztai’s experiment was eventually published as a letter in The Lancet in 1999. Because of the controversial nature of his research the letter was reviewed by six reviewers – three times the usual number. One publicly opposed the letter, another thought it was flawed, but wanted it published “to avoid suspicions of a conspiracy against Pusztai and to give colleagues a chance to see the data for themselves” while the other four raised questions that were addressed by the authors. The letter reported significant differences between the thickness of the gut epithelium of rats fed genetically modified potatoes, compared to those fed the control diet.
Pusztai’s annual contract at Rowett was not renewed following the incident and he moved back to Hungary. He has been giving lectures on his GM potato work and on claimed dangers in general of genetic engineering of crop plants. In 2005, he received the Whistleblower Award from the German Section of the International Association of Lawyers against Nuclear Arms (IALANA) and the Federation of German Scientists (VDW). In 2009, Pusztai and his wife received the Stuttgart peace prize (Stuttgarter Friedenspreis).
There is no “robust” evidence that renewable energy developments are hurting Scotland‘s tourism industry, a parliamentary inquiry has said.
Holyrood’s economy committee also said the Scottish government’s ambitious green energy targets could be met.
But MSPs warned they were being put at risk because of a lack of finance.
Ministers want to see the equivalent of 100% of Scotland’s electricity needs generated from renewable sources by 2020, as part of its drive to make the country Europe’s green “capital”.

Mr Trump, who gave evidence in person to the inquiry, is opposing plans to build an offshore wind farm near his £1bn golf resort in Menie, Aberdeenshire.
He said Scotland was committing “financial suicide” by wanting to create a “wind farm landscape”.
The businessman told the inquiry wind farms were inefficient, could not operate without big subsides, “killed massive amounts of wildlife” and would damage tourism.
When challenged to provide statistical evidence for his arguments, Mr Trump told the committee in April: “I am the evidence”, adding: “I am considered a world-class expert in tourism, so when you say, ‘where is the expert and where is the evidence’, I’m the evidence.”
In its inquiry report, the committee said: “No witness has provided the committee with robust, empirical evidence, as opposed to anecdotal comment and opinion, that tourism is being negatively affected by the development of renewable projects.”
Responding to the committee’s findings, the Trump Organisation suggested the inquiry was a “white wash”, adding: “The report, with findings like these, does not inspire confidence – it fails entirely to address the costs to the public and the impact on tourism, communities and the lives of ordinary people.
“This government cannot be trusted, they will say and do anything, including lie, to support their political goals.
“The Scottish economy is condemned to suffer a downward spiral, if this thinking continues – global investors be warned.”
Elsewhere, the economy committee report warned the green energy targets were at risk because companies were struggling to get finance, and said the planning system and investment in industry skills must be looked at.
Elsewhere, the committee said:
Significant investment in infrastructure is needed to grow the renewables industry amid a “reluctance” of some banks to invest, particularly in small and medium sized projects;
Renewable energy skill shortages means there is a risk the target will not be met without investment in science, technology, engineering and maths at school, college and universities.
Under-pressure councils need help due to high volumes of planning applications.
Greater consideration of the economic benefits of community renewable projects should be considered under the planning system.
The UK government should “end industry uncertainty” by finalising their Renewables Obligation Certificate levels.
The Scottish islands are still disadvantaged by the electricity transmission and charging system, making many projects “uneconomic”.
The target to generate 11% of heat demand from renewable sources by 2020 is at risk because of issues surrounding local and domestic heating schemes.
Economy committee convener Murdo Fraser said: “The electricity target can be achieved, but only if the issues outlined in this report are acted upon.
MSPs on the committee said action was needed for Scotland to meet its green energy targets
“Our recommendations are crucial to the success of the renewables industry in Scotland, and focus on issues such as access to finance, the planning system, infrastructure development and investment in skills.”
The Tory MSP said the Scottish and UK governments would have to work together to meet some of the aims in the report.
Mr Fraser added: “The overwhelming message from investors was that strong leadership, and a robust and reliable investment climate and subsidy regime is critical for the targets to be met.
“The committee regrets the reluctance of some banks to invest and in the current financial environment, is concerned that the renewables industry will not have access to the finance it needs to grow, which will ultimately put the targets at risk.”
Scottish energy minister Fergus Ewing welcomed the report’s conclusion that the renewable energy target could be met.
He added: “We welcome the committee’s acknowledgement that renewable energy is a ‘safe bet’ to provide energy security for the people of Scotland and protect us all from energy price shock.
“The positive tone of this report reflects the widespread belief across the industry, the government and its agencies and key stakeholders that renewable energy can deliver huge benefits for Scotland’s people.”
The government welcomed the report.
The country’s biggest local authority, Dublin City Council, is owed a massive €380m by various debtors — and a new report urges that rents be deducted directly from social welfare payments paid to 70 per cent of its tenants.
Projecting an income of over €72m from 24,000 tenants this year, which is described as the single most important source of council revenue after rates, the report said direct deduction at source from social welfare payments will “result in substantial savings and efficiencies”.
The report from the City Council Finance Department says that despite the current economic circumstances of tenants “rent arrears have stabilised for 2010-12”.
